The Music Industry's Ongoing Battle With YouTube

The music industry has an ongoing beef with YouTube about insufficient royalties for the unending number of unlicensed music on the site. Apparently $3 billion was paid out by YouTube but it’s definitely not enough. Record Label heavyweights are trying to make a strategic move to correct this. Renowned artist manager Irving Azoff, calls out the site for abusing the loopholes in the Digital Millennium Copyright Act (DMCA). In the “Safe Harbor” provision, websites aren’t responsible for copyright issues and YouTube doesn’t make the user face more consequences than removing the said song/video. The artist has to send formal notices for each individual upload for action to be taken, which is pretty much impossible.

Due to this discrepancy, the industry has decided to take a stand to change the Safe Harbor provision. Along with a petition signed by thousands of industry heads and artists, industry heads are putting a lot of pressure to encourage the US government to change the amendments. “The DMCA has become a problem because companies that were clearly pirates could hide behind it,” claimed Recording Industry Association of America CEO Cary Sherman. “That’s a Hobson’s choice for any company, they either get some revenue, but way below market, or they get no revenue and spend all their time and money trying to take down all the tens of thousands of illegal copies that are on YouTube.” Artists are stuck in the middle as they don’t get enough royalties for their music but removing everything unlicensed would also greatly reduce internet exposure. Neither side wants to compromise, and no one is remembering that the artists opinion is what matters the most.
